So the seat in my laser broke in busted which allowed it to go backwards and eject me from the car. I realize my car is 18 years old but I still think the seat should stand up to a crash after 18 years or are seats only designed to last 10....or something stupid. My question is should this have happened? If my seat wouldnt have broke I would not been ejected and suffered the injuries I did. Do I have a possible legal case here?

i wouldnt see why not. a friend of mine got realy messed up cuz of a seatbelt and he got payed even though the car was 12 years old and they were being "chased" by a cop.he wasnt chasing them but he was gonna pull them over for speeding and they were trying to ditch him when they hit a loaded potato truck at like 80 mph

my insurance lapsed like 3 days before my accident im wondering if I could go after diamond star motors/mitsubishi for the seat breaking I dont think that should happen even after 18 years its not like there is much were on tear on the seat and its not like it can really get damaged. I mean I only way 165 pounds.

the fact you werent wearing your lapbelt may be an issue^

still the other belt would have held me in if the seat didnt lean backwards....i never rolled the car. at worst i would have had cuts and srapes

did the seat or the studs break and how? Faulty design parts failure can all play a part.

Or if the seat hadn't broken you could have been wrenched sideways and the upper belt may have broken your neck. I suspect at this stage unless you can prove materials defect in the seat and no unreasonable wear that you will never get anywhere with this.

If the brackets were rusted through, no chance. If they weren't and the car was immaculate and you weren't doing anything illegal or using the car for any unintended uses, maybe. Hope you have a really good lawyer who works for cheap, car companies have teams of lawyers to make sure you don't get a penny.

it wasnt the brackets the broke its in the mechanism to lean it back that broke. It only locks all the way forward or all the way back now. nothing to do with the brackets that hold the seat in.

oh and im 6'5" the least thing I was worried about was the seatbelt breaking my neck.

I rolled my dd back in 2007 and I was partially ejected out of my sunroof. I was wearing my seatbelt and going about 55 mph. My airbag never deployed and my seatbelt snapped after the first roll. It was 1999 Civic and I got nothing from Honda for it...which was mental, in my opinion.
It's definitely worth calling up a lawyer for and looking into.

damn thats one hell of a ride too! Ive been playing phone tag with one of the best lawfirms in the state. Im hoping to find out something from them tomorrow.
